Terms and Conditions of Use

Platform: PickBazaar (pickbazaar.co)

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "Customer", "Merchant", "Delivery Partner") and PickBazaar Technologies ("Company", "PickBazaar", "we", "us"). By accessing our mobile applications or website, you agree to be bound by these Terms.

1. The Platform Model (Marketplace)

PickBazaar operates as a technology facilitator and hyper-local marketplace platform connecting:

• Customers seeking to purchase groceries, dairy, fresh produce, and consumer goods.
• Independent Store Merchants ("Sellers") who prepare, package, and sell goods.
• Independent Logistics Riders ("Delivery Partners") contracted to transport items from merchants to customer locations.

2. User Accounts & Verification

• Users must be at least 18 years of age or access under parental guidance.
• You agree to provide true, accurate, current, and complete mobile phone numbers and delivery details.
• You are solely responsible for maintaining the confidentiality of any SMS verification OTPs received. PickBazaar representatives will never ask for your OTP or banking PIN.

3. Pricing, Product Catalog & Weights

• All product prices are displayed in Indian Rupees (INR) inclusive of applicable goods and services taxes (GST).
• For fresh produce (fruits, vegetables, meats), slight weight variances may naturally occur during manual cutting or weighing. Merchants strive to match or exceed indicated packaging quantities.
• PickBazaar reserves the right to cancel any order originating from inadvertent pricing glitches or system display errors prior to shipment.

4. Orders, Payments & Invoicing

• Orders are confirmed once successfully accepted by the nearest partner merchant and routed to the logistics network.
• Payments can be made using UPI (Google Pay, PhonePe, Paytm), Credit/Debit cards, Net Banking, or Cash on Delivery (COD) where available.
• Digital tax invoices are generated automatically for each fulfilled order and stored inside the Order History section of the customer application.

5. Prohibited Conduct

Users, Merchants, and Delivery Partners agree not to:

• Engage in fraudulent orders, chargeback abuse, or spoofing GPS locations.
• Harass, abuse, or demean delivery riders or store support staff.
• Attempt reverse-engineering, decompilation, or scraping of the PickBazaar application, API, or databases.
• Distribute unlicensed, contraband, or illegal substances via the marketplace.

6. Intellectual Property

The trademarks, branding, logos, app UI designs, software code, and visual identities of "PickBazaar" and pickbazaar.co are the proprietary intellectual property of PickBazaar Technologies. Unauthorized reproduction or imitation is strictly forbidden.

7. Limitation of Liability

While PickBazaar exercises stringent partner onboarding standards, the ultimate quality, packaging integrity, and manufacturer warranties for packaged goods rest with respective third-party manufacturers and licensed store merchants.

8. Governing Law & Dispute Jurisdiction

These Terms shall be construed and governed in accordance with the laws of India. Any legal dispute, arbitration, or proceedings shall be subject to the exclusive jurisdiction of the competent courts in India.
